What Happens to Belongings Damaged by Mold?

Mold-damaged furniture, clothing and electronics are recoverable losses. How to document them, what renters insurance usually does, and what to keep.

Property loss is the most consistently undervalued part of a California mold claim, and almost always for the same reason: the tenant threw everything away before anyone photographed it.

By the time a claim is being assessed, a mattress, a sofa, a wardrobe of clothes and a box of books have become a sentence in a witness statement rather than an itemized loss. That difference is worth real money.

What typically gets damaged

Porous and absorbent items are the ones usually written off:

  • Mattresses, bedding, pillows, upholstered furniture
  • Clothing, shoes, bags — particularly anything stored in a closet against an affected wall
  • Books, documents, photographs, artwork
  • Wood furniture, especially particleboard and veneer
  • Rugs and carpet
  • Electronics and instruments stored in affected rooms
  • Children’s soft toys and car seats

Some of it can be professionally cleaned. Much of it cannot, and the cost of trying sometimes exceeds replacement.

Document before you discard

Do this before anything leaves the unit.

  1. Photograph each item individually, with the damage visible, and a wider shot showing where it was.
  2. Make a written inventory — item, make or model, approximate age, what you paid, what replacement costs now.
  3. Find proof of ownership and value — receipts, bank or card statements, order confirmation emails. Online purchase histories are often the easiest route.
  4. Keep what you can. Bag it, label it, store it somewhere dry. A preserved item beats a photograph of one.
  5. Keep replacement receipts for anything you buy to cope in the meantime.

If an item genuinely cannot be kept — a saturated mattress in a small apartment — photograph it thoroughly from several angles first, including any visible growth, and record the date of disposal.

Do not throw everything out the same day

The instinct is to clear it all immediately, and it is completely understandable. But once it is gone, the only evidence is your description of it.

Where there is any prospect of a claim, keep representative items if you can — particularly the most valuable ones and anything showing clear growth. If health concerns make that impossible, seal items in bags and store them outside the living space rather than destroying them.

Where renters insurance fits

Renters policies vary enormously in how they treat mold, and many contain specific mold exclusions or sub-limits that are far lower than the headline contents figure. Whether a loss is covered often depends on the underlying cause — sudden water escape is treated differently from gradual seepage or long-term damp.

Read your policy, and claim if the cover exists. Insurance and a claim against a landlord are not mutually exclusive, though how they interact depends on the facts and on what your insurer does afterwards.

We cover the related question of what renters insurance does and does not do in a separate article.

How property loss is valued

Expect the distinction between replacement cost and actual cash value to come up. Replacement cost is what it costs to buy the item new today. Actual cash value reduces that for age and wear. Which applies can depend on the policy or on how the claim is framed.

A documented inventory with proof of purchase gives you something to argue from. A list written from memory six months later does not.

Do not sign away the claim for a rent credit

Landlords sometimes offer a modest rent credit or a goodwill payment in exchange for a release. Property loss is frequently the largest single component of a mold claim, and a few hundred dollars of credit can extinguish it entirely.

Have anything described as a settlement, waiver or release read before you sign it.

If you are clearing out a unit this week

We represent tenants and homeowners in mold and habitability matters across California — tenants only, never landlords. If you are about to discard damaged belongings, it is worth a short call first; what you do in the next few days is largely what the claim will rest on. Mold and habitability matters are handled on contingency, so there is no attorney’s fee unless we recover for you, and the consultation is free. Clients are responsible for case costs.

My apartment had mold and management was dragging their feet to resolve it, and completely mishandling the situation. Then I retained Alex and long story short, I was able to hold management accountable and collect a sizeable settlement. Alex was professional, responsive, and most importantly he didn’t oversell or over promise a settlement number. He was really easy to work with and he went toe to toe with the insurance adjuster when they tried to delay the process with last minute changes. I’d recommended Alex to friends, family and internet strangers, LOL. He’s someone you need on your side.

Amazing experience with Alex. We were in a last minute contractual bind and needed additional protection, as the docs we started to receive were very complex and lengthy. Alex was super responsive and extremely quick. He simplified item, that we didn’t understand, to make sense to us. And he provided amazing advice. Our deal moved forward, with countless protections added to our side. We feel very grateful for this and highly recommend him. Thanks so much Alex!

Alex has been a huge help as we work through a difficult tenant situation. He has gone above and beyond and has treated the issue with the same care and attention he would give his own. His guidance has been incredibly valuable, and he is always willing to answer questions, whether they are directly related to the case or not. Working with Alex feels like having a trusted legal advisor on call. He is responsive, dedicated, and focused on actually moving things forward. He is not the kind of attorney who just runs up the bill without getting results. We truly appreciate everything he has done and highly recommend him.
