What makes a rental legally uninhabitable
California recognises an implied warranty of habitability in residential tenancies. In plain terms, a landlord must keep the unit fit to live in. Mold is the condition we are asked about most, but it is far from the only one.
- No heat, or heating that does not work
- No hot water, or water that is unsafe
- Plumbing failures, leaks, and sewage backups
- Rats, mice, roaches and other infestations
- Broken or missing locks, windows or doors
- Faulty wiring and electrical hazards
- Structural problems — floors, stairs, ceilings, railings

Habitability is judged on the condition and how long it went unaddressed, not on whether the landlord meant well.
The two things that decide most cases
Written notice. A landlord who was told in writing and did nothing is in a very different position from one who was never told. Text and email create a dated record; a phone call to the manager usually does not.
Documentation before the repair. Once a wall is opened and repainted, the evidence is gone. Photograph conditions as they are, with dates, and keep photographing as things change.

Options tenants ask about
Reporting to the city. The Los Angeles Housing Department inspects habitability complaints. In our experience an official inspection changes more cases than anything else a tenant can do alone. How to report a problem to LAHD.
Repair and deduct, and rent withholding. California law provides limited remedies that let tenants address repairs themselves or stop paying rent in defined circumstances. Retaliation and eviction
California law addresses retaliation against tenants who assert their habitability rights within a protected period. In our experience a landlord who retaliates after a complaint tends to strengthen the tenant’s position rather than weaken it. How a habitability case usually runs

- We build the record. Your photographs, your messages to the landlord, repair histories, inspection reports, medical records.
- We establish what the landlord knew, and when. This is usually the pivot of the whole case.
- We connect the conditions to your losses. Health effects, damaged property, rent paid for a unit that was not habitable, the cost of moving.
- We deal with the other side. The landlord, the management company and their insurer speak to us, not to you.
Common questions
Do I have to move out first? No. We work with tenants still living in the unit and with tenants who have already left. Staying does not mean you accepted the condition.
What if I am behind on rent? That does not automatically end a habitability claim, but it changes the strategy and the timing. Tell us early rather than late.
What if my building is rent-stabilized? Los Angeles’ Rent Stabilization Ordinance may apply to buildings constructed before October 1978, which covers much of the city. RSO coverage affects rent increases and eviction protections, so it is worth confirming early.
How long do I have? Deadlines vary with what the claim is for. Our advice is not to wait — evidence disappears once repairs are made.
