Can My Landlord Evict Me for Complaining About Mold?

California Civil Code 1942.5 protects tenants for 180 days after a habitability complaint, and carries damages and fees. What it covers, and what it does not.

It is the fear that stops most tenants complaining in the first place, and it is a reasonable one. California anticipated it.

The 180-day rule

Civil Code section 1942.5(a) provides that where a landlord retaliates because the tenant has exercised rights under the habitability chapter, or because the tenant complained to an appropriate agency about tenantability, and where the tenant is not in default as to the payment of rent, the landlord may not:

  • Recover possession of the dwelling in any action or proceeding
  • Cause the tenant to quit involuntarily
  • Increase the rent
  • Decrease any services

— within 180 days of the triggering event. Those events include giving notice in good faith under section 1942, and filing a written complaint (or an oral complaint that is recorded in writing) with an appropriate agency, of which the landlord has notice, for the purpose of obtaining correction of a tenantability condition.

Read the condition carefully

The protection applies to a tenant not in default as to the payment of rent.

This is the single most important sentence on this page. It is why we generally advise tenants to keep paying rent while pursuing a mold problem through other means. Withholding rent can forfeit the protection at precisely the moment it is most needed — see can I withhold rent for mold in California.

What it is not

Section 1942.5 is not a shield against all eviction forever. A landlord may still pursue possession for genuine, independent reasons unrelated to the complaint. The protection addresses retaliation — action taken because of the complaint.

Nor does complaining make a tenancy permanent. What it does is place the landlord’s stated reason under scrutiny, and shift how a court looks at timing.

What makes retaliation provable

Timing is the heart of it, and timing is established with documents.

  • The date of your complaint — which is why written notice matters so much. See how to prove your landlord knew.
  • The date of the landlord’s action — keep the notice, the envelope, the rent increase letter.
  • The gap between them. A notice to quit arriving eleven days after a code enforcement complaint tells its own story.
  • Any change in the stated reason. Landlords who shift explanations damage their own position.
  • Your payment record. Clean rent history is both a condition of the protection and powerful evidence.

What the statute provides if it is violated

Section 1942.5(h) makes a lessor or their agent who violates the section liable to the tenant for:

  • Actual damages sustained by the tenant
  • Punitive damages of not less than $100 and not more than $2,000 for each retaliatory act, where the lessor or agent has been guilty of fraud, oppression or malice with respect to that act

Subdivision (i) adds that in an action for damages for retaliatory eviction, the court shall award reasonable attorney’s fees to the prevailing party where either party requests them at the initiation of the action.

Subdivision (j) confirms these remedies are in addition to any others available under statute or case law.

The attorney’s fees provision is worth understanding. It cuts both ways, but it means a tenant with a genuine retaliation claim is not priced out of bringing it.

If you have received a notice

  1. Do not ignore it. Unlawful detainer timelines in California are short and unforgiving. Deadlines can be measured in days.
  2. Do not move out automatically. Leaving may be exactly what the notice is designed to achieve.
  3. Keep paying rent if you are able, for the reason above.
  4. Assemble the timeline — complaint date, agency complaint if any, and the date of every adverse action, with the documents.
  5. Get advice immediately. This is the one situation in this series where waiting a week genuinely costs you options.

Talk to us quickly

We represent tenants and homeowners in mold and habitability matters across California — tenants only, never landlords. If something has changed since you complained — a notice, a rent increase, services cut — the timeline matters and it is worth a call today rather than next week. Mold and habitability matters are handled on contingency, so there is no attorney’s fee unless we recover for you, and the consultation is free. Clients are responsible for case costs.

My apartment had mold and management was dragging their feet to resolve it, and completely mishandling the situation. Then I retained Alex and long story short, I was able to hold management accountable and collect a sizeable settlement. Alex was professional, responsive, and most importantly he didn’t oversell or over promise a settlement number. He was really easy to work with and he went toe to toe with the insurance adjuster when they tried to delay the process with last minute changes. I’d recommended Alex to friends, family and internet strangers, LOL. He’s someone you need on your side.

Alex has been a huge help as we work through a difficult tenant situation. He has gone above and beyond and has treated the issue with the same care and attention he would give his own. His guidance has been incredibly valuable, and he is always willing to answer questions, whether they are directly related to the case or not. Working with Alex feels like having a trusted legal advisor on call. He is responsive, dedicated, and focused on actually moving things forward. He is not the kind of attorney who just runs up the bill without getting results. We truly appreciate everything he has done and highly recommend him.
