My Landlord Says the Mold Is My Fault — What Now?

California landlords blame tenant habits for mold. Civil Code 1941.2 is narrower than they claim. What the statute requires, and how to answer the argument.

It is the standard response, and most California tenants hear some version of it:

You shower too long. You do not open the windows. You dry clothes indoors. You never run the fan. This is condensation, and condensation is a lifestyle issue.

Sometimes that argument has merit. Far more often it is the cheapest available alternative to opening up a wall. Here is what California law actually requires before a landlord can put the problem on you.

The statute landlords are relying on

Civil Code section 1941.2 lists the tenant’s own obligations — keeping the unit clean and sanitary as the condition of the premises permits, disposing of rubbish properly, using plumbing and electrical fixtures properly, and not damaging the premises.

Civil Code section 1941.7 then provides that no duty to repair mold arises if the tenant is in violation of 1941.2.

So the argument is real. But read what section 1941.2 requires before it bites.

The two conditions landlords skip

Section 1941.2 says the landlord’s duty does not arise where the tenant is in substantial violation of those obligations — and only where the tenant’s violation contributes substantially to the condition, or substantially interferes with the landlord’s ability to make the repairs.

Both qualifiers matter.

“You could have opened a window more often” is not a substantial violation of a statutory obligation. Nor is showering. Nor is cooking. These are ordinary uses of a dwelling, and a building is supposed to tolerate them. The clean-and-sanitary obligation is also expressly limited by what the condition of the premises permits — which cuts directly against blaming a tenant for damp in a unit that cannot be kept dry.

Ventilation is a building system, not a habit

The condensation argument usually collapses on one question: was the unit capable of being ventilated?

If the bathroom extractor fan does not work, vents into the attic rather than outside, or was never installed; if windows are painted shut, broken, or absent in the affected room; if the unit has no trickle vents and no mechanical ventilation — then the inability to clear moisture is a defect of the building. Health and Safety Code section 17920.3 lists both “lack of, or improper operation of required ventilating equipment” and “dampness of habitable rooms” as substandard conditions in their own right.

A tenant cannot be blamed for failing to use ventilation that does not exist or does not work.

When the argument is simply wrong on the facts

Condensation mold and water-intrusion mold tend to look and behave differently. Where the mold is concentrated, what is behind the wall, and whether the pattern follows a plumbing run, a roof line or a shared wall are all questions with answers.

These causes are not lifestyle issues under anyone’s reading:

  • Roof and window leaks
  • Plumbing leaks, including slab leaks and leaks from the unit above
  • Failed waterproofing or rising damp
  • Defective or absent extraction
  • Prior water damage that was dried inadequately — very common, and usually documented in the landlord’s own records
  • Repairs that painted over a damp surface instead of addressing the source

That last one deserves attention. If mold returns in the same place after a repair, the repair did not address the cause. A recurrence is evidence about the building, not about the tenant.

What to do when you are blamed

  1. Do not accept it in writing. Do not sign anything agreeing the mold was caused by your use of the unit, and do not accept a rent credit or repair in exchange for a release without having it read first.
  2. Answer in writing, calmly. State what you believe the source is, that you are asking for the cause to be identified rather than the surface cleaned, and that you dispute the suggestion that your use of the unit caused it.
  3. Document the ventilation. Video the extractor fan running — or failing to. Hold a tissue to it. Photograph windows that do not open.
  4. Ask what inspection was done. A conclusion about cause reached without opening anything up or taking a moisture reading is an assertion, not a finding.
  5. Get an independent determination. Health and Safety Code section 17920.3(a)(13) contemplates visible mold being determined by a health officer or a code enforcement officer. A city or county inspection is independent of both you and the landlord.

Watch what comes next

Being blamed is sometimes the first step rather than the last. If a rent increase, a reduction in services or a notice to quit follows your complaint, Civil Code section 1942.5 generally protects a tenant who is not in default on rent for 180 days after a good-faith habitability complaint. See retaliation after a mold complaint.

My apartment had mold and management was dragging their feet to resolve it, and completely mishandling the situation. Then I retained Alex and long story short, I was able to hold management accountable and collect a sizeable settlement. Alex was professional, responsive, and most importantly he didn’t oversell or over promise a settlement number. He was really easy to work with and he went toe to toe with the insurance adjuster when they tried to delay the process with last minute changes. I’d recommended Alex to friends, family and internet strangers, LOL. He’s someone you need on your side.

Alex has been a huge help as we work through a difficult tenant situation. He has gone above and beyond and has treated the issue with the same care and attention he would give his own. His guidance has been incredibly valuable, and he is always willing to answer questions, whether they are directly related to the case or not. Working with Alex feels like having a trusted legal advisor on call. He is responsive, dedicated, and focused on actually moving things forward. He is not the kind of attorney who just runs up the bill without getting results. We truly appreciate everything he has done and highly recommend him.
